Insurance Adjusters and Personal Injury Claims

Contrary to their TV ads, insurance companies don’t really care; they are profit driven corporations. State Farm is not really a good neighbor and Allstate doesn’t actually hold you in good hands. State Farm and Geico, like many other companies, spend millions in advertising to give the impression that they are on the consumer’s side.  It’s only after one of their insurance adjusters makes an appearance when a claim is filed that most consumers realize their insurance company is not their friend.  In fact, while they offer policies at competitive prices, all insurance companies are known to be notoriously unreasonable when it comes to settling a claim. For instance, many lawyers have described situations in which insurance companies have offered $1,850.00 to settle a case when their client has unpaid medical bills exceeding $2,000.00. Not only do such offers fail to cover medical expenses, they fail to compensate injury victims at all for the permanent injuries they may have suffered. The result is that Insurance companies and their policyholders get sued far more often than should be necessary.

Bicycle and Pedestrian Personal Injury Victims: Danger in Duval County

Florida is one of the three most dangerous states in the United States for pedestrians, bicyclists and motorcyclists; that is especially true in Duval County. Cyclists are at risk for serious injury due to negligent inattention and lack of awareness by drivers. For example, in 2018 and 2019 the total number of traffic fatalities in the entire state of Florida was similar. However, in Duval County, the number of fatal crashes has continued to rise. Eighty one of the one hundred sixty three people who died on Duval County roads were pedestrians, bicyclists or on a motorcycle - not in cars, SUVs or trucks.

Slip or Trip and Fall Injuries - Things to Do and a Few Not to Do

Slippery surfaces, wet surfaces, foreign liquids and debris, inconspicuous bumps, humps and   If you were injured because of a fall, you may have a premises liability claim if it can be shown that the fall was caused by a hazard the property owner knew about but failed to correct. It may not be possible to accomplish all of these suggestions but accomplishing any of them will be helpful to your case: elevation changes, broken or loose tile, raised or tattered carpeting, broken or unsturdy stair banisters, poor lighting and exposed holes all cause trip or slip and fall injuries.

The Cause - Identify the substance or condition that caused the fall. Those could include liquids, foreign objects and debris; some examples are: detergent, water, cooking oil, dried beans, sand, freshly mopped floors or unshelved store merchandise on the floor.

“Full Coverage” Is Not Full Coverage In Florida; You Need UM Coverage Too.

The phrase “full coverage” is a misleading insurance industry marketing term to convince drivers that they are buying all the insurance coverage protection they need - at a great price. The phrase is a marketing ploy to sell insurance. “Full coverage” actually means that you may be purchasing the bare minimum of coverage required to legally register a car in Florida.

What is PIP or "No-Fault" Insurance and Who Does it Benefit?

PIP or personal injury protection insurance is essentially $10,000.00 in medical insurance for car and truck crash injuries; it also available to pay some wage loss. Hospitals and doctors should bill your PIP insurance company directly. Thus, it is necessary that you provide your automobile insurance card, and you claim number if available, to every hospital and doctor that treats you so that the cost of your visit can be billed.

PIP is referred to as “No Fault” insurance because it pays for both medical treatment and wage loss – no matter who was “at fault” for causing the crash. This means that you do not have to prove who was, or was not, at fault for the crash. So, even if you cause a crash, your PIP insurance company still has to pay your medical expenses; for example, if you are injured after intentionally leaving the roadway to avoid hitting a pedestrian. Similarly, if a negligent driver hits your car, Florida law nonetheless requires that your own PIP insurance pay for the first $10,000.00 in covered expenses – even if you did nothing wrong. Good News: The fact that your insurance company has paid your medical expenses will not result in an increase of your insurance premium – as long as you are not at fault for the crash.
